This privacy policy (the “Policy”) is designed to inform users of the dpHUE website (the "Site") about how DMP COLOR, LLC, dba dpHUE ("dpHUE," "we," or “us”) gathers and uses personal information submitted to us via the Site. dpHUE will take reasonable steps to protect user privacy consistent with the guidelines set forth in this policy and with applicable U.S. laws. In this policy, "user" or "you" means any person viewing any page of the Site.
Information We Collect
When you visit the Site, you may provide information to us or we may collect it automatically though tracking technologies.
Information You Provide to Us
Individual Information: Through this Site, dpHUE may collect individual information directly from users purchasing or expressing interest in purchasing dpHUE products, or registering to receive dpHUE emails or text messages. This information may be personally identifying and includes: (a) if you purchase products from dpHUE, your name, email address, physical and/or postal address, telephone number, and credit card number; and (b) if you only register to receive our newsletter, take a “hair quiz” on our website, or participate in a product giveaway contest, your email address or telephone number.
Payment Information: If you provide payment information, including credit card or financial account information, for products through the Site, the information is used only to fulfill the transactional purpose for which you submit it to us and may be processed by a third-party vendor on our behalf.
Job Applications: We may collect certain personally-identifiable information you provide to us when you apply for a job on our Site, such as your name, address, telephone number, mailing address, and email address. Information collected in the application process is explicitly not included in the scope of this Policy and is not personally-identifiable information as described throughout this Policy.
Stylists Participating in dpHUE Professional programs and services ( “Pro Ambassadors”): In order for Pro Ambassadors to participate in these programs and services, Pro Ambassadors provide the following:
• Your name, current address, and email address;
• A current copy of your license to practice cosmetology issued by a State within the continental United States (your “License”);
• A properly completed and executed Form W-9;
• The email address that is linked to your Paypal account and permits you to receive payments (your “Payment Address”); and
• any other items required and noted within the Professional Terms & Conditions to start connecting your clients to dpHUE Products.
This information is only used for purposes of those programs and services.

Tracking Technologies
The Site uses web tracking technologies such as cookies to recognize visitors to the Site and to analyze general user traffic patterns.
Cookies and Device Identifiers: A cookie is a small file placed on your device when you visit a website that can be understood by the website that issued the cookie. We use cookies and other technologies, including device identifiers, to collect information and support certain features on the Site. For example, we may use these technologies to:
- collect information about how visitors use the Site (for example, which pages they visit, which links they use, and how long they stay on each page);
- support the features and functionality of the Site (for example, to save a visitor the trouble of re-entering information already in our database or to prompt the settings they established on previous visits);
- personalize a visitor’s experience when they use the Site; and
- improve our marketing efforts, including targeted advertising.

Information from Your Computer or Mobile Device: When you access our Site through your computer or mobile device, we automatically collect certain information from and/or about your device, such as IP address, access dates and times, information about your approximate location (as determined through your IP address), hardware and software information, mobile, and computer or hardware device information. If you consent to receiving text messages from us, our text-messaging service provider may also share information about your location with us. This helps us understand when messages from us might be most relevant to you.
How Do We Use the Information We Collect?
Individual Information: We will use the individual information you provide to us to fulfill orders, and to send hard-copy and email marketing materials and newsletters to you if you have not opted-out of receiving that information. If you make a purchase on dpHUE.com using your Pro Ambassador’s unique discount code or click-through link, your Pro Ambassador will be able to see:
- Order Number
- Order Date
- Customer Full Name
- Order Amount
- Products Purchased
If you make a purchase on dpHUE.com using a Pro Ambassador’s unique discount code or click-through link, dpHUE shares the above information with the Pro Ambassador and certain of its service providers, including one of the referral marketing platforms we engage to manage our different product ambassador programs (each a “Referral Platform”). Pro Ambassadors and the applicable Referral Platform may not use this information other than with regard to the Pro Ambassador programs, and neither a Pro Ambassador nor the Referral Platform may share or disclose this information to any third parties or otherwise use the information.
In addition, from time-to-time, we partner with individuals outside of dpHUE to help us deploy a referral marketing strategy by which these individuals help promote our products and offer discounts (each a “Consumer Ambassador”). We also engage a Referral Platform to manage these Consumer Ambassadors, and, if you make a purchase on dpHUE.com using your Consumer Ambassador’s unique discount code or click-through link, the Referral Platform will be able to see:
- Order Number
- Order Date
- Customer Full Name
- Order Amount
dpHUE shares this information with certain of its service providers and an applicable Referral Platform to facilitate the purchase and discount process; this information is not shared with the Consumer Ambassadors, and the Referral Platform may not use the above information other than with regard to the Consumer Ambassador program. It may not share or disclose this information to any third parties or otherwise use the information.
If you sign up for an email newsletter, you have the option to unsubscribe at any time—simply follow the “unsubscribe” instructions included in our email newsletter. If you have opted-in to receiving text messages from us, our texting terms and conditions apply.
Aggregate Information: We will also use our customer information to create data for analytical purposes. This statistical information does not contain any directly identifying information and is used to understand our customer base and to market dpHUE products.
Tracking Technologies: We use site-tracking information only in an aggregate form that does not identify the individual user, and only for us to understand how well our Site is working. For example, we may develop deidentified or aggregate statistical information on Site and content usage (which we may disclose to business partners and investors), such as by keeping count of return visitors to the Site and assessing which pages of the Site are most popular. This allows us to determine which features visitors like best, to help us improve our content and the Site, to personalize your user experience, and to measure overall Site effectiveness. Tracking technologies also enable third-party analytics and advertising tools.
Third-Party Analytics Tools: dpHUE utilizes analytics tools, including, third-party technologies, such as Google Analytics, to collect information and help us understand how visitors engage with our Sites. Third-Party Advertising Tools: Third parties may deliver cookies to your computer or mobile or tablet device for the purpose of tracking your online behaviors across nonaffiliated websites and deliver targeted advertisements either on our Site or on other websites.

Legal Exception: Notwithstanding the above, dpHUE may in any event use information collected through the Site to the extent required by law or legal process, or if in dpHUE’s reasonable discretion use is necessary to protect dpHUE’s legal rights or to protect third parties.
What Information Do We Disclose to Third Parties?
Individual information: dpHUE does not sell* or rent its mailing list. It only discloses your individual information to third parties in the following circumstances: (i) to contractors (such as couriers and fulfillment houses) in order to process your order; (ii) for a third party’s direct marketing purposes only if we have received your consent to share your individual information for such purpose; or (iii) to Pro Ambassadors and Referral Platforms as described under “How Do We Use the Information We Collect?”. However, dpHUE reserves the right to disclose any information dpHUE collects in connection with the Site (a) to any successor to dpHUE’s business as a result of any merger, acquisition or similar transaction; and (b) to any law enforcement or regulatory authority, to the extent required by law or if in dpHUE’s reasonable discretion disclosure is necessary to protect dpHUE’s legal rights or to protect third parties.
*"Sell” as used here is as the word is commonly understood, and not as defined in the California Consumer Privacy Act.
Anonymous, Aggregated Information: We may disclose anonymous, aggregated information to third parties such as potential business partners and funding sources, in order to describe our business and operations.
Children’s Privacy
Our Site is not intended for individuals under the age of 16. Children under 16 years old may not use the Site without the written permission of a parent or guardian. If you believe that a child under the age of 16 has submitted information on or through our Site without the consent and supervision of a parent or guardian, please contact us as indicated below.
California Privacy Rights
Shine the Light: California Civil Code Section 1798.83 permits users of our Site who are California residents to request certain information regarding our disclosure of personal information to other parties for their direct marketing purposes. Amendments: dpHUE may modify or amend this policy from time to time. If we make any material changes, as determined by dpHUE, in the way in which individual information is collected, used or transferred, we will update the effective date at the top of this Privacy Policy. Notwithstanding any modifications we may make, any individual information collected by dpHUE from you will be treated in accordance with the privacy policy in effect at the time information was collected, unless we obtain your consent otherwise.
Site visitors from outside the United States: dpHUE and its servers are located in the United States and are subject to the applicable state and federal laws of the United States.
